ARTICLE 2 – Definitions
In this Form:
Seller: refers to Giya Kuyumculuk Limited Şirketi,
Consumer: refers to the natural person purchasing the products for personal use,
Product(s): refers to the goods or services offered for sale on the websites www.giyamucevherat.com or www.giya.com.tr and covered by this Form.
ARTICLE 3 – Subject
The subject of this Preliminary Information Form (“Form”) is to inform the Consumer regarding the
sale and delivery of the products (“Products”) specified below in terms of their features and sales
price, in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation
on Distance Contracts published in the Official Gazette No. 29188 dated 27 November 2014.
ARTICLE 4 – Basic Features and Payment Information of the Products
4.1 The description, unit price, quantity, and payment terms of the Products are provided below and have been confirmed by the Consumer.
4.2 The shipping fee shall be paid by the Consumer.
ARTICLE 5 – Validity Period of Commitments
The prices stated in Article 5.1 are the sales prices. Declared prices and promises remain valid until updated or changed. Time-limited prices are valid until the specified expiration date.
ARTICLE 6 – Delivery of Products
6.1 The Products shall be delivered to the address indicated by the Consumer, or to the person/
institution designated by them, together with the invoice, packaged securely and intact, within a
maximum of 30 days from the date of order. If the Seller fails to fulfill this obligation, the Consumer
may terminate the contract.
6.2 If the Products are to be delivered to another person designated by the Consumer, the Seller
cannot be held responsible if that person refuses to accept the delivery.
6.3 The Consumer is obliged to inspect the Products upon delivery and immediately notify the Seller of any visible defects.
ARTICLE 7 – Right of Withdrawal
7.1 In distance contracts regarding the sale of goods, the Consumer has the right to withdraw from the contract within 14 (fourteen) days from the delivery date of the Products to themself or the designated person, without providing any reason and without incurring any legal or penal liability.
7.2 To exercise the right of withdrawal, the Consumer must notify the Seller in writing via registered mail with return receipt, email, or fax within the 14-day period.
7.3 The Products to be returned must be delivered along with their original box, packaging, and
any standard accessories, if any.
7.4 Upon receiving the withdrawal notice, the Seller is obliged to refund the total amount and
return all documents that put the Consumer under obligation within 14 (fourteen) days. The Seller
will make the refund using the same payment method used by the Consumer, without imposing
any costs or obligations on the Consumer.
(If the Consumer made the purchase using an installment option with a credit card, the
refund will still be made in full to the bank, and the bank may refund the amount to the
Consumer in installments. This does not constitute a breach of this article.)

7.5 The cost of return shipping for Products returned due to withdrawal will be borne by the Seller.
ARTICLE 8 – Products for Which the Right of Withdrawal Cannot Be Exercised
The right of withdrawal cannot be exercised for contracts relating to goods made upon the
Consumer’s request or clearly customized to the Consumer’s personal needs, or goods that are
not suitable for return due to their nature. Additionally, the right of withdrawal cannot be used for sound or video recordings, software programs, and computer consumables if the packaging has
been opened by the Consumer.
ARTICLE 8 – General Provisions
8.1 The Consumer declares that they have read and understood the preliminary information
regarding the basic characteristics of the Products, sales price, payment terms, and delivery prior to concluding the contract, and confirmed them in writing.
8.2 By confirming this Form in writing, the Consumer acknowledges that they have received all necessary information, including the Seller’s address, the main features of the Products ordered, total price including taxes, and delivery and payment details.
8.3 The Seller shall not be held liable for issues caused by the courier company that prevent the
delivery of the Products to the Consumer.
8.4 The Seller is responsible for delivering the Products in a complete, undamaged condition, in
accordance with the specifications stated in the order, and accompanied by the warranty documents and user manuals, if applicable.
8.5 If it becomes apparent that the Seller cannot procure the Products before the delivery deadline, the Seller may supply an alternative Product of equal quality and price with the written consent of the Consumer.
8.6 If the delivery of the Products becomes impossible, the Seller shall inform the Consumer
before the contractual obligation period expires and shall refund the total amount within 10 (ten) days.
8.7 If the Product price is not paid for any reason or the transaction is canceled in the bank records, the Seller is deemed released from the obligation to deliver the Products.
8.8 If the payment for the Products is not made to the Seller for any reason, the Consumer shall return the Products to the Seller within 3 days of being notified, at their own expense. The Seller reserves all contractual and legal rights, including debt recovery.
ARTICLE 9 – Competent Court
In case of disputes or complaints, the Consumer may apply to the Consumer Arbitration Committee or Consumer Court in the place of residence or where the product/service was purchased, within the monetary limits announced annually by the Republic of Turkey Ministry of Trade.
ARTICLE 10 – Other Provisions
This Preliminary Information Form shall be electronically read and accepted by the Consumer
prior to the conclusion of the Distance Sales Agreement.
